1. Services

Egma ("Egma", "We", "Us", or "Our") is a product of Outlier Humans Inc. Egma is an open-source platform for simulation testing, production monitoring, and observability of voice agents. These Terms and Conditions ("Terms") govern your access to and use of our websites, documentation, APIs, and any hosted services we operate (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree with these Terms, you may not access or use our Services.

2. Open-Source Software

The Egma platform software is released under the Apache License 2.0. Your rights to use, copy, modify, and distribute that software are granted by, and governed solely by, the Apache License 2.0 — not by these Terms. Nothing in these Terms restricts any right granted to you under that license.

These Terms govern only our websites, documentation, and any hosted service we operate. Where these Terms and the Apache License 2.0 conflict with respect to the software, the Apache License 2.0 controls.

The Apache License 2.0 does not grant trademark rights. Outlier Humans Inc retains all rights in the Egma name, logo, and brand. You may make nominative reference to Egma; you may not use our marks in a way that suggests endorsement or affiliation without prior written consent.

The open-source Egma platform is available free of charge under the Apache License 2.0. Where we offer a paid hosted or supported service, the following apply:

You are solely responsible for the use of any output generated by Egma, including simulated conversations, transcripts, recordings, measures, and grader verdicts ("Output"). You acknowledge that:

You agree not to disclose any confidential information belonging to Egma, including non-public business plans and pricing information, to any third party without prior written consent. This does not apply to anything published under our open-source license or otherwise made public by us.

8. Warranties, Indemnification, and Liability

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, EGMA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

You agree to indemnify and hold harmless Egma, Outlier Humans Inc, and their respective officers, directors, employees, and affiliates from any claims arising out of your use of the Services or violation of these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EGMA'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU DURING THE 12-MONTH PERIOD PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS HIGHER.

9. Term and Termination

These Terms are effective upon your first use of our Services. You may terminate at any time by discontinuing use and cancelling any subscription. Egma reserves the right to suspend or terminate your access to our websites and hosted services at any time, with or without cause. Termination of these Terms does not terminate the Apache License 2.0 grant covering the open-source software.

10. Governing Law

11. Changes to These Terms

Egma reserves the right to modify these Terms at any time. Material changes will be communicated via our website or email. Continued use after changes constitutes acceptance of the revised Terms.
